Partner visa (Subclasses 309 and 100) (apply overseas)

Benefit: Subclasses 309 and 100 visa allows the partner or spouse of an Australian citizen, Australian permanent resident or eligible New Zealand citizen to live in Australia.

Duration of stay:

  • Subclass 309 visa: Temporary stay until subclass 100 visa is granted.
  • Subclass 100 visa: Permanent residency

Cost: From AUD 8.850 (covers both visas)

Processing time:

  • Subclass 309 visa: Approximately 13 to 32 months
  • Subclass 100 visa: Approximately 11 to 45 months

Basic visa conditions of subclasses 309 and 100:

For the applicant:

  • Be outside Australia when applying for the visa (applies to accompanying family members as well)
  • Be at least 18 years old
  • In a genuine relationship with an eligible Australian citizen, permanent resident, or eligible New Zealand citizen
  • Have a sponsoring spouse who meets eligibility criteria and is willing to sponsor
  • Meet health and character requirements
  • No previous visa cancellations/refusals
  • Pay your debts to the Australian Government
  • Understand and sign the Australian Values Statement
  • Be in or outside Australia when the Department grants the visa.
  • Maintain a genuine and ongoing relationship with the sponsoring spouse or partner.
